Terms of Service

Orchestra Kingdom ("we", "us", "our") is a software service operated by Orchestra Kingdom LLC, a Delaware limited liability company. We build AI audition training for string musicians. "You" means any person who creates an account or uses the service.

You must be 13 years of age or older to create an account or submit audio. Users between 13 and 17 must have a parent or guardian complete age verification before paid features or audition submissions are unlocked. If you are under 13, you may not use Orchestra Kingdom under any circumstances. See the COPPA section of our Privacy Policy for how we handle data from minors.

You are responsible for all activity under your account. Keep your credentials secure. If you believe your account has been compromised, email security@orchestrakingdom.com immediately.

Judge Mode returns AI-generated feedback based on pitch, timing, and acoustic analysis of your recording. It is not a substitute for a human teacher, and no score or verdict we return guarantees any real-world audition outcome. Results depend on your instrument, microphone quality, recording environment, practice history, natural ability, and the specific audition panel you face. None of those factors are in our control.

Scores, verdicts, and written feedback are practice signal. They reflect what our analysis pipeline can measure, not the judgment of a real audition panel. Any testimonials or case studies we share represent individual results and are not typical.

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. We will not delete your account data during a planned service change without giving you time to export it first.

Paid plans are billed monthly or annually through Stripe. Your subscription renews automatically at the end of each billing period unless you cancel. You can cancel anytime from the account dashboard billing portal; access continues through the end of the paid period. We do not prorate partial months on cancellation.

For annual plans, we send a renewal-reminder email at least 7 days before each annual charge so you can cancel before it bills.

Free trials convert automatically to a paid plan at the end of the trial period unless canceled before the trial ends. We send a reminder at least 3 days before conversion.

Founding 100 is a lifetime monthly rate locked at $24.99/mo for as long as you remain an active subscriber. If you cancel a Founding 100 membership, the locked rate is forfeited and cannot be reclaimed. See our Refund Policy for the Founding 100 no-refund-after-30-days rule, which is disclosed at the point of purchase.

The following are prohibited on Orchestra Kingdom:

• Scraping or automated bulk extraction of content or feedback
• Submitting audio you do not have the right to submit
• Attempting to reverse-engineer the judging pipeline or extract model weights or prompts
• Creating accounts for the purpose of gaming review metrics
• Using the service to harass or defame others
• Sharing account credentials or reselling access to the service
• Uploading malicious content, malware, or anything designed to disrupt the service

You own your recordings and your feedback reports. By submitting a recording, you grant us a limited, non-exclusive, royalty-free license to process it through our pipeline for the sole purpose of returning your feedback. Audio is discarded after analysis unless you explicitly opt in to storage. We do not use your recordings to train third-party AI models, and we do not sell your practice data.

You can close your account at any time from account settings. On voluntary closure, paid access ends at the next billing cycle and your profile and practice data are deleted within 30 days per our Privacy Policy. Billing records are retained longer for tax and accounting compliance.

We may suspend or terminate accounts that violate these Terms. Grounds for suspension or termination include: repeated acceptable-use violations after warning, fraudulent payment activity, chargebacks filed in bad faith, submitting illegal content, or credible evidence that an account was created to circumvent an earlier termination.

For non-emergency violations, we will send a warning email before taking action and give you a reasonable opportunity to respond. For severe violations (fraud, illegal content), we may suspend immediately and notify you within 24 hours. Refunds on terminated accounts are handled case-by-case.

To the extent permitted by applicable law, our total liability for any claim arising from these Terms or the service is limited to the amount you paid us in the 12 months before the claim arose. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any specific audition outcome will result from use of the service.

Any dispute arising from or relating to these Terms or the service will be resolved through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. You and Orchestra Kingdom waive the right to a jury trial and to participate in a class action or class-wide arbitration. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm while arbitration is pending.

You may opt out of the arbitration requirement by emailing legal@orchestrakingdom.com with subject "Arbitration opt-out" within 30 days of first accepting these Terms. The opt-out applies only to arbitration, not to the class-action waiver. If arbitration is found unenforceable in your jurisdiction, disputes will be resolved in state or federal courts in Delaware.

Arbitration proceedings take place in Wilmington, Delaware, or by video conference if both parties agree.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

We will notify you by email at least 14 days before material changes to these Terms take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms. If you disagree with a change, you may close your account before it takes effect and request a prorated refund for unused time on annual plans.
